Child Support

In Georgia, child support is determined by agreement of the parties or order of the court after being calculated on a Child Support Worksheet. In order to determine the amount of child support that the non-custodial parent will pay to the custodial parent, a number of figures are input into the child support worksheet, while the inputs vary depending on the facts of the custodial situation, the spouses incomes, amount paid by a spouse for the child or children's health insurance, and day-care or after-school care costs, if applicable, are nearly always factored into the child support calculation.

The Georgia Child Support Commission provides the Georgia Child Support Worksheet as well as instructions about child support calculations to the public. You can download the Child Support Calculators here: http://cscalc.gaaoc.us.

However, an experienced family law attorney will be able to best advise you about what information or inputs to include on a child support worksheet and whether you may be able to benefit and whether a court would likely accept a deviation from the presumptive amount of child support.

Duration

Duration

Generally, child support in Georgia continues to be an obligation for the supporting parent until their child or children graduate from high school. If their child or children turn twenty (20) years old before they graduate from high school (but while they are still enrolled and attending high school) child support would terminate at that time.

In Georgia, there is not an automatic provision that allows for the reduction of child support when one child in a family "ages out" or graduates from high school. Deviation

Deviation

The Georgia Child Support Worksheet provides for the possibility of a "deviation" based on various events or circumstances. A deviation creates either an increase or decrease in child support as compared to the presumptive amount listed on the child support worksheet. Deviations can be taken for high or low income of the parents, travel expenses necessary to exercise parenting time, dental or vision insurance, among other things.
